Quebec Court Judge Josee Belanger found the 50-year-old man guilty of possessing, distributing and accessing child pornography while he was still serving the 15-year sentence he received for abusing his daughter.

While delivering her decision, Belanger referred to the man as "X.X." because his real name cannot be published in order to protect the identities of his victims.

During the summer of 2019, X.X. was transferred from the Archambault Institution, a federal penitentiary, to a halfway house in the Eastern Townships where he met another convicted pedophile. He told the other offender he had access to a device that had more than 1,000 images of very young girls and boys stored on it. He also said he had photos of his daughter and his niece on the device.

X.X. lent the device to the offender and someone working at the courthouse caught him with it soon after. The employee told the offender he wouldn't be returned to a penitentiary if he revealed where he got the device from.

The offender kept silent and was returned to a penitentiary north of Montreal where he eventually admitted to police it was X.X. who lent him the device.

A Montreal police investigator who analyzed the device determined that, out of the 1,263 photos on it, 1,013 could be considered to be child pornography.

"Fifty per cent of the files involved sexual abuse committed by an adult on a child of varying ages, from a few months to seven years old," Belanger said.

The Montreal police investigator knew of X.X.'s past and asked the Surete du Quebec if he could look at the evidence from the trial held at the Montreal courthouse in 2005. The comparison confirmed that X.X. had three photos of his daughter on the device.

The case will enter the sentencing stage in mid-December.
